By using the UPCInet Classifieds web site, or any of its affiliated sites, you agree to the following Terms of Service.

 

Summary of Terms of Service

A. You agree not to use the service for illegal purposes or for the transmission of  objectionable material.

B. You agree NOT to include a link/s or a reference to any ad on UPCInet Classifieds or any of its affiliated sites in any "junk mail", "spam", "chain letters", or "unsolicited email".

 

C. You agree that UPCInet Classifieds may in their sole discretion terminate your account with or without refund if they believe you have in any way violated the Terms of   Service.

 

D. You agree NOT to post ads that pertain to Bulk E-mail.

 

E. You agree NOT to post ads that promote any services or products that conflict with the services and products offered by UPCInet or any division of the United Pentecostal Church International. 

F. You agree NOT to post ads to external sites that you are an affiliate of. We do not allow ads to external company websites that pass affiliate IDs in the URL line, or any other form of affiliate ID pass-through. Example: Posting ads to a website like Amazon.com with your affiliate ID is NOT allowed.

G.  We reserve the right to refuse any ad based upon any possible conflict with the services we offer at UPCI.

 

H. You agree NOT to post duplicate ads.

I.  We reserve the right to verify United Pentecostal Church membership through contact of the local church and/or pastor for posting in certain categories. 

 

I. ACKNOWLEDGMENT AND ACCEPTANCE OF TERMS OF SERVICE

 

UPCInet Classifieds (the "Service"), is provided to you ("User") under the terms and conditions of this UPCInet Classifieds Terms of Service (UPCInet), any amendments thereto, and any operating rules or policies that are posted on the UPCInet Classifieds website. The UPCInet comprises the entire agreement between User and UPCInet Classifieds and supersedes any prior agreements pertaining to the subject matter contained herein. BY POSTING AN AD, YOU ARE AGREEING TO BE ABIDE BY THE UPCInet TERMS AND CONDITIONS.

II. MODIFICATIONS TO SERVICE

 

UPCInet Classifieds reserves the right to modify or discontinue, temporarily or permanently, the Service with or without notice to User. User agrees that UPCInet Classifieds shall not be liable to User or any third-party for any modification or discontinuation of the Service.

III. CONDUCT

 

User agrees to abide by all applicable local, state, national, and international laws and regulations in User's use of the Service. User agrees to be solely responsible for the contents of User's advertisement/s through the Service.

IV. TERMINATION

 

User agrees that UPCInet Classifieds may terminate User's account or use of the Service if UPCInet Classifieds believes that (a) User has violated or acted inconsistently with this agreement, or (b) User has violated the rights of UPCInet Classifieds or other Users or parties.

 

User acknowledges and agrees that any termination of service under this Agreement and under any provision of this Agreement may be effected without prior notice (only in extreme cases). User also acknowledges and agrees that UPCInet Classifieds may immediately delete any ads associated with the User's account.

V. URL LINKING TO EXTERNAL SITES 

 

The UPCInet Classifieds allows users to post links to other external sites. An external site is defined as any site that is not owned by UPCInet Classifieds. User acknowledges and agrees that UPCInet Classifieds and its affiliates are not responsible for the availability of such external sites or its resources, and is not responsible or liable for any content, advertising, or other material on or available from such sites. User agrees that UPCInet Classifieds shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on such external sites, or as a result of being advertised on an external site. Moreover, UPCInet Classifieds does not guarantee any submissions to an external site or that the Power Submission program will work at any time.

In addition, posting ads to external websites that you are an affiliate of is NOT allowed. External websites must be YOUR OWN website, and must not forward users to another website. We reserve the right to verify that any website that you post a link to is your own.

VI. DISCLAIMER, INDEMNITY AND WARRANTIES

 

UPCINET CLASSIFIEDS AND ITS AFFILIATES DISCLAIMS ANY WARRANTIES EXPRESSED OR IMPLIED ON GOODS OR SERVICES LISTED ON THE SERVICE.  SELLERS ASSUME ALL RISK ON LIABILITY ARISING FROM THEIR OFFER FOR SALE OF ANY ITEM.

UPCINET CLASSIFIEDS AND ITS AFFILIATES CANNOT BE LIABLE FOR THE ACCURACY OF THE INFORMATION CONTAINED IN THE SERVICE, OR THE CONTENTS OF ANY ADVERTISEMENTS, OR FOR THE CLAIMS OR OMISSIONS THEREIN. THE SERVICE SHALL NOT BE LIABLE FOR ANY THIRD-PARTY CLAIMS OR LOSSES OF ANY NATURE, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PUNITIVE OR CONSEQUENTIAL DAMAGES.

 

UPCINET CLASSIFIEDS MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER'S REQUIREMENTS, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES UPCINET CLASSIFIEDS MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE, OR THAT DEFECTS IN THE KINGDOM CLASSIFIEDS SERVICE OR SOFTWARE WILL BE CORRECTED.

 

USER AGREES TO INDEMNIFY AND HOLD UPCINET CLASSIFIEDS, AND THEIR AFFILIATES HARMLESS FROM ANY CLAIMS, INCLUDING ATTORNEYS' FEES, MADE BY ANY THIRD PARTY, DUE TO OR ARISING OUT OF USE OF THE SERVICE, USER'S CONNECTION TO THE SERVICE, OR USER'S VIOLATION OF THIS AGREEMENT.

 

THIS AGREEMENT SETS FORTH THE ENTIRE AGREEMENT BETWEEN UPCINET CLASSIFIEDS AND USER WITH RESPECT TO THE SUBJECT MATTER HEREOF AND SUPERSEDES ALL PREVIOUS REPRESENTATIONS, UNDERSTANDINGS OR AGREEMENTS AND SHALL PREVAIL NOTWITHSTANDING ANY VARIANCE WITH TERMS AND CONDITIONS OF ANY OTHER PRIOR WRITING BETWEEN THE PARTIES. IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID BY A COURT OF COMPETENT JURISDICTION, THEN THE REMAINING PROVISION SHALL NEVERTHELESS CONTINUE IN FULL FORCE AND EFFECT. CUSTOMER MAY NOT TRANSFER OR ASSIGN THIS AGREEMENT WITHOUT THE PRIOR WRITTEN CONSENT OF UPCINET CLASSIFIEDS. THIS AGREEMENT SHALL BE GOVERNED BY THE LAWS OF THE STATE OF MISSOURI AND ALL CLAIMS CONCERNING THIS AGREEMENT SHALL BE BROUGHT EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN THE COUNTY OF ST. LOUIS IN THE STATE OF MISSOURI. THE PARTIES HEREBY CONSENT TO SUBMIT TO THE JURISDICTION OF SUCH COURTS AND WAIVE ANY PERSONAL JURISDICTION OR VENUE DEFENSES CONCERNING SAID FORUM. WE RESERVE THE RIGHT TO CHANGE OR MODIFY THIS AGREEMENT AT ANY TIME.
